Efficiency in the Judicial Review of Administrative Acts in Kosovo

Abstract

This article examines the efficiency of judicial review of administrative acts in Kosovo by analyzing the Clearance Rates (CR) and disposition time (DT) in administrative cases during 2020–2024, using the CEPEJ methodology. Drawing on quantitative data from Kosovo and comparative data from CEPEJ and OECD sources, the study assesses the performance trends and Kosovo's position compared to the Western Balkans and Council of Europe (CoE) countries. The findings show that, despite some improvements, the efficiency of the judicial review of administrative acts in Kosovo remains a persistent structural challenge, particularly at the court of first instance, where backlog accumulation and prolonged DT are evident. Comparatively, Kosovo follows regional trends and converges with the CoE benchmarks at the second instance, while the first instance level indicates lower performance with slight variations. The article identifies key factors contributing to inefficiency and discusses the recently introduced reforms in the Kosovo judicial review system by providing evidence on the efficiency of the judicial review of administrative acts in Kosovo, regional and European perspective.
